Terms of Service

Please read carefully. By creating an account or using HomePro, you agree to these Terms of Service. If you do not agree, do not use the platform.

1. About HomePro

HomePro ("we," "us," "our," or "the Platform") is a SaaS marketplace operated at www.home.design that connects homeowners ("Homeowners") with home renovation service providers ("Service Providers"). HomePro is a technology platform — we are not a general contractor, construction company, or party to any renovation contract between Homeowners and Service Providers.

By registering an account, you represent that you are at least 18 years old, have the legal authority to enter these Terms, and will use the Platform in compliance with all applicable laws.

2. Account Registration & Roles

2.1 Roles

Users register as either a Homeowner or a Service Provider. Role selection determines the features and obligations available to you under these Terms. You may not misrepresent your role to gain unauthorized access to features.

2.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately at support@homepro.app if you suspect unauthorized access. HomePro is not liable for losses caused by unauthorized use of your account.

2.3 Google Sign-In

If you authenticate using Google, you authorize HomePro to access your Google account profile and, where requested, your Google Drive and YouTube account for the limited purpose of uploading project media on your behalf. You may revoke this authorization at any time from your Google account settings.

3. Platform Fees & Payments

3.1 Project Lead Fee — Service Providers

When a Homeowner invites a Service Provider to bid on a project, the Service Provider must pay a non-refundable $100 Project Lead Fee to accept the invitation and access the full project details. This fee does not guarantee award of the project. Homeowners are never charged a Lead Fee.

3.2 Team Seat Subscription — Service Providers

Service Providers may add employees or contractors to their HomePro business account. Each additional seat costs $50 per seat per month, billed on a recurring basis via Stripe. Seats are prorated upon addition and canceled at the end of the current billing cycle upon removal.

3.3 Payment Processing

All payments are processed by Stripe in accordance with Stripe's terms. HomePro does not store credit card numbers. By submitting payment, you authorize the applicable charge. Disputed charges must be raised within 60 days of the transaction date.

3.4 Refund Policy

Project Lead Fees are non-refundable once a Service Provider has accessed the project details. Seat subscription fees for the current billing month are non-refundable. Unused portions of a canceled subscription will not be refunded. We may issue refunds at our sole discretion in cases of platform error.

3.5 Price Changes

We reserve the right to modify fee amounts with 30 days' notice to existing subscribers via email. Continued use of paid features after the effective date constitutes acceptance.

4. Homeowner Terms

  • You may create projects and invite Service Providers at no cost.
  • You are responsible for ensuring project descriptions are accurate and lawful.
  • You acknowledge that HomePro does not vet, license-verify, or insure Service Providers. You are solely responsible for verifying credentials, checking references, and executing contracts directly with Service Providers.
  • Contracts, invoices, and payments between you and a Service Provider are your own agreements — HomePro provides tools to facilitate them but is not a party to them.
  • You grant HomePro a non-exclusive, royalty-free license to display project photos and videos you upload for the purpose of operating the Platform (e.g., sharing them with invited Service Providers).

5. Service Provider Terms

  • You represent that you hold all required licenses, permits, and insurance required by your jurisdiction to perform the services you offer.
  • You agree to pay the $100 Project Lead Fee before accessing a project.
  • You will provide accurate information about your business, capabilities, and pricing.
  • You will not contact Homeowners through channels outside the Platform for the purpose of circumventing Lead Fees.
  • HomePro reserves the right to remove any Service Provider who receives sustained low ratings, engages in fraudulent conduct, or violates these Terms.

6. AI Studio & 3D Generation

HomePro's AI Studio features (DALL-E 3 image generation, Fal AI Hyper3D Rodin 3D models) are provided as creative tools. You acknowledge that:

  • AI-generated designs are for visualization purposes only and do not constitute architectural, engineering, or construction advice.
  • Prompts you submit are transmitted to OpenAI and Fal AI under their respective terms of service.
  • You must not submit prompts that violate any third-party intellectual property rights, are defamatory, or are otherwise unlawful.
  • HomePro may cache AI-generated assets and serve them to you and other users who submit identical prompts as a cost-optimization feature.

7. Material & Retailer Links

The Materials Browser in the Renovation Studio displays curated product information from third-party retailers including The Home Depot and Floor & Decor. HomePro is not affiliated with, endorsed by, or responsible for the pricing, availability, or quality of any third-party products. Product links direct you to retailer websites where their own terms apply. HomePro does not earn affiliate commissions from retailer clicks.

8. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any regulation
  • Impersonate another person or misrepresent your affiliation
  • Circumvent any security feature or access control mechanism
  • Scrape, harvest, or reverse-engineer any part of the Platform
  • Transmit malware, spam, or unsolicited communications
  • Post false, defamatory, or misleading reviews
  • Use the Platform to facilitate any transaction outside of it to avoid fees
  • Violate any third-party intellectual property right through AI prompt submissions or media uploads

9. Intellectual Property

9.1 HomePro IP

All software, design, trademarks, and content created by HomePro are owned by HomePro and protected by applicable intellectual property law. You receive a limited, non-exclusive, non-transferable license to use the Platform for its intended purpose.

9.2 Your Content

You retain ownership of content you upload (photos, videos, project descriptions). By uploading, you grant HomePro a worldwide, royalty-free license to use, display, and process your content solely to operate the Platform and provide services to you.

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. HOMEPRO DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. WE MAKE NO WARRANTY REGARDING THE QUALITY, RELIABILITY, OR SUITABILITY OF ANY SERVICE PROVIDER FOUND THROUGH THE PLATFORM.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOMEPRO'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE TOTAL FEES YOU PAID TO HOMEPRO IN THE 12 MONTHS PRECEDING THE CLAIM. IN NO EVENT WILL HOMEPRO BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

12. Indemnification

You agree to indemnify, defend, and hold harmless HomePro and its officers, directors, employees, and agents from any claims, liabilities, damages, and costs (including reasonable attorneys' fees) arising from (a) your use of the Platform, (b) your violation of these Terms, (c) your violation of any third-party right, or (d) any renovation services performed or contracted through the Platform.

13. Termination

HomePro may suspend or terminate your account at any time for violation of these Terms, fraudulent conduct, or for any reason with 30 days' notice (except where immediate termination is required to protect the Platform or other users). You may terminate your account at any time by contacting support@homepro.app. Active subscriptions will not be prorated on voluntary termination.

14. Dispute Resolution

Any dispute arising from these Terms shall first be addressed by contacting support@homepro.app. If not resolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the American Arbitration Association Commercial Arbitration Rules. Class action waiver: You agree to resolve disputes only on an individual basis and not as part of any class action.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict-of-law principles.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email at least 30 days before taking effect. Your continued use of the Platform after the effective date of any changes constitutes your acceptance.
